Now More Than Ever

The same people who brought you the current world financial crisis were working hard three years ago to keep ordinary people from getting relief from the burden of the cheap credit they careated, by lobbying for the passage of the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA).

What they accomplished was an extraordinary piece of Beltway-speak, even by Washington standards. The Act (which most debtor attorneys refer to as BARF, and one bankruptcy judge has been known to call BAP-CRAPPA) did precious little to prevent bankruptcy abuse and absolutely nothing to protect consumers. Its sole aim was to make it more difficult and more expensive for ordinary people to file for bankruptcy protection.

The disinformation campaign that accompanied and followed the enactment of BAPCPA, however, was even more harmful than the Act itself. The credit and banking industries, as much as they had won, wanted still more. They wanted the ordinary American to believe that bankruptcy was now all but impossible to file, so much so that it would be worthless to even consider it as an option.

For the first eighteen months or so, they succeeded. But then groups like the National Association of Consumer Bankruptcy Attorneys and the National Consumer Law Center began to make inroads in the media, and the word got out that bankruptcy was, for most ordinary folks, not out of reach. The bankruptcy filing rates, in most areas, have now returned to their pre-2005 levels. The word is out.
