The Empathy Issue

It is incoherent to say that a judge should base an opinion on reason and not emotion because emotions are an inherent part of decision-making. Emotions are the processes we use to assign value to different possibilities.

The Bogus Torture Coverup

In Federalist Paper #51, James Madison wrote that “If men were angels, no government would be necessary. In framing a government which is to be administered by men over men, the great difficulty lies in this: you must first enable the government to control the governed; and in the next place oblige it to control itself.” This is what happens when the latter fails.

The Daily Beast has confirmed that the photographs of abuses at Iraq’s Abu Ghraib prison, which President Obama, in a reversal, decided not to release, depict sexually explicit acts, including a uniformed soldier receiving oral sex from a female prisoner, a government contractor engaged in an act of sodomy with a male prisoner and scenes of forced masturbation, forced exhibition, and penetration involving phosphorous sticks and brooms.

The Economy of North Korea

Why am I posting this on a law blog? Because it is one more illustration of how this isn’t your grandfather’s world and we’re not in Kansas anymore. One of the most repressive regimes on earth is losing its secrecy, involuntarily. The Internet is ubiquitous and uncontrollable.

Melvin created a great plug-in for Google Earth that identifies key features in North Korea. You can see the huge estates of the elite and the explosive growth of public markets. You can compare the nice neighborhoods in big cities to the near absence of development in the North East mountains.
